These terms and conditions applies to all work carried out by Property Maintenance Jersey

1. About Us

1.1 PMJ Property Maintenance Jersey ("PMJ", "we", "us" or "our") is a sole trader business providing cleaning, property maintenance, repairs and associated services throughout Jersey, Channel Islands.

1.2 Our principal business address is Green Road Corner Shop, La Grève d'Azette, St Clement, Jersey, JE2 6QA.

1.4 These Terms & Conditions govern the use of our website and, where incorporated into a customer's agreement with PMJ, the booking and provision of our services.

2. Website Use

2.1 By accessing or using our website, you agree to comply with these Terms & Conditions insofar as they relate to website use.

2.2 We make reasonable efforts to ensure that the information provided on our website is accurate and up to date. However, service descriptions, prices and availability may change.

2.3 You agree not to misuse the website, interfere with its operation, attempt unauthorised access or use its content for unlawful purposes.

3. Services and Bookings

3.1 Customers may request services through our website, online booking forms, email, telephone or WhatsApp.

3.2 All bookings are subject to availability and confirmation by PMJ. Submission of a booking request does not automatically guarantee an appointment.

3.3 PMJ may decline a booking where the requested work falls outside our capabilities, presents unreasonable safety risks or cannot reasonably be completed.

3.4 Customers are responsible for providing accurate information regarding the property, requested services and any relevant access requirements.

3.5 Changes to the agreed scope of work must be approved by PMJ and may result in additional charges or revised completion dates.

4. Quotations and Pricing

4.1 Prices displayed on our website are indicative unless expressly stated to be fixed prices for a defined service.

4.2 Fixed-price services are subject to the scope and conditions specified at the time of booking.

4.3 Services requiring an assessment will be quoted individually based on the nature and extent of the work.

4.4 Where additional work is identified, we will inform the customer and seek approval before proceeding with work that would incur additional charges.

4.5 Quotations will specify any applicable taxes and additional charges.

4.6 Quotations are valid for the period stated. Where no validity period is specified, customers should confirm that the quotation remains current before accepting it.

5. Payment Terms

5.1 Payment for services is required in full in advance of the scheduled appointment, unless otherwise agreed in writing by PMJ.

5.2 The total price, including any applicable taxes and agreed additional charges, will be communicated before payment is requested.

5.3 Bookings may remain unconfirmed until the required advance payment has been received.

5.4 For larger maintenance projects or ongoing service arrangements, alternative payment schedules may be agreed in writing.

5.5 Where services are cancelled, postponed or not provided, any refund will be handled in accordance with Section 6 and applicable Jersey law.

6. Cancellations and Rescheduling

6.1 Customers are requested to provide at least 48 hours' notice when cancelling or rescheduling a confirmed appointment.

6.2 Cancellations made more than 48 hours before the scheduled appointment will ordinarily qualify for a full refund, unless agreed non-refundable costs have reasonably been incurred and may lawfully be retained.

6.3 Cancellations made within 48 hours of the scheduled appointment may be subject to a cancellation charge, provided that the charge or its method of calculation has been clearly communicated and agreed before booking confirmation, is reasonable and is permitted by law.

6.4 Where advance payment has been made, any lawful and agreed cancellation charge may be deducted from the refund.

6.5 If PMJ cancels an appointment and cannot offer an acceptable alternative, payment for services not provided will be refunded in accordance with applicable law.

6.6 Nothing in this policy affects statutory cancellation rights, including rights under the Distance Selling (Jersey) Law 2007.

6.7 Customers wishing to cancel should contact us at info@pmj.je or through another cancellation method expressly agreed at booking.

7. Property Access and Customer Responsibilities

7.1 Customers must ensure that PMJ personnel have safe and reasonable access to the property at the agreed appointment time.

7.2 Customers should disclose any known hazards, including unsafe electrical installations, structural defects, hazardous substances or animals that may present a safety risk.

7.3 Where reasonably necessary, customers should ensure that water, electricity and other essential utilities are available.

7.4 Customers should secure valuables, important documents and fragile items before work begins.

7.5 Where access cannot be obtained or conditions prevent work from proceeding safely, PMJ may need to reschedule or cancel the appointment.

7.6 Any charge arising from failed access or unsafe conditions must be reasonable, legally permitted and disclosed in advance.

8. Cleaning Services

8.1 Cleaning services will be carried out according to the agreed scope of work.

8.2 Customers should identify any delicate surfaces, specialist materials or items requiring particular cleaning methods before work begins.

8.3 While we aim to achieve a high standard of cleaning, certain stains, marks, discolouration, odours and existing damage may not be removable through normal cleaning methods.

8.4 End-of-tenancy cleaning is intended to bring the property to the agreed cleaning standard. PMJ cannot guarantee the return of a tenancy deposit, as this may depend on matters outside our control.

8.5 Where cleaning results do not meet the agreed standard, customers should contact us promptly so that we can investigate and, where appropriate, arrange corrective work.

9. Property Maintenance and Repairs

9.1 Maintenance, repair and installation work will be carried out in accordance with the agreed quotation or service description.

9.2 Where unexpected defects, concealed damage or additional requirements are discovered, PMJ will notify the customer before proceeding with any material changes to the agreed work.

9.3 Electrical, plumbing and other specialist services will be undertaken by appropriately competent personnel and, where required by Jersey law, persons holding the necessary registrations, licences or qualifications.

9.4 Estimated completion dates may change where unexpected conditions, material availability or other reasonable circumstances affect the work.

9.5 PMJ will take reasonable care to protect the property and surrounding areas while services are being performed.

10. Quality of Work and Consumer Rights

10.1 PMJ will provide services with reasonable care and skill in accordance with the Supply of Goods and Services (Jersey) Law 2009.

10.2 Where a completion time has not been agreed, services will be performed within a reasonable time as required by applicable law.

10.3 Goods and materials supplied as part of our services will comply with applicable statutory requirements.

10.4 Customers who believe work has not been completed to the agreed standard should contact PMJ with details of the concern.

10.5 We will investigate complaints fairly and, where appropriate, offer corrective work or another remedy consistent with the customer's legal rights.

10.6 Nothing in these Terms & Conditions excludes or restricts statutory consumer rights.

11. Damage and Liability

11.1 PMJ will take reasonable care when working at a customer's property.

11.2 If damage occurs as a result of our negligence, breach of contract or failure to exercise reasonable care and skill, we will assess the circumstances and our legal responsibility.

11.3 PMJ is not responsible for damage or deterioration caused solely by pre-existing defects, ordinary wear and tear or circumstances outside our reasonable control, except where liability arises under applicable law.

11.4 Customers should notify us as soon as reasonably possible after discovering any damage believed to have resulted from our work.

11.5 Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.

12. Photographs and Documentation

12.1 PMJ may take photographs before, during or after work for operational purposes, including quotations, condition reports, quality assurance and records of completed services.

12.2 Photographs containing personal information will be handled in accordance with applicable Jersey data protection legislation.

12.3 Photographs identifying a customer's property or containing personal information will not be used for public marketing without an appropriate lawful basis and any necessary permission.

12.4 Customers may contact PMJ if they have questions about photographs taken during a service.

13. Privacy and Data Protection

13.1 PMJ processes personal information in accordance with the Data Protection (Jersey) Law 2018 and other applicable legislation.

13.2 Personal information may be collected when customers submit enquiries, request quotations, book services or communicate with us.

13.3 Information may be used to respond to enquiries, arrange appointments, deliver services, process payments and fulfil legal obligations.

13.4 Personal information may be shared with service providers or contractors where necessary and lawful for delivering the requested services.

13.5 Further details about how personal information is collected, used, stored and protected, including individual rights, will be provided in our separate Privacy Policy.

14. Intellectual Property

14.1 Unless otherwise stated, website content, including text, photographs, graphics, logos and branding owned by PMJ, remains the intellectual property of PMJ.

14.2 Website content may not be reproduced, distributed or used commercially without prior written permission from the relevant rights holder.

14.3 Customers may view and download website content for lawful personal and non-commercial purposes.

15. Third-Party Websites and Services

15.1 Our website may contain links to external websites or services, including booking and communication platforms.

15.2 PMJ is not responsible for the content, availability or privacy practices of independently operated third-party websites.

15.3 Use of third-party services may also be subject to the relevant provider's terms and conditions.

16. Circumstances Beyond Our Control

16.1 PMJ will not be responsible for delays or failures to perform contractual obligations to the extent caused by circumstances beyond our reasonable control, where permitted by law.

16.2 Such circumstances may include severe weather, natural disasters, significant supply disruptions or other unforeseen events.

16.3 Where possible, we will notify affected customers and make reasonable efforts to rearrange services.

16.4 Any rights to refunds, cancellation or other remedies under applicable law remain unaffected.

17. Governing Law and Disputes

17.1 These Terms & Conditions are governed by and construed in accordance with the laws of Jersey, Channel Islands.

17.2 Any disputes arising in connection with our services or website will be subject to the jurisdiction of the courts of Jersey, without affecting any mandatory legal rights available to consumers.

17.3 Customers are encouraged to contact PMJ directly in the first instance so that concerns can be investigated and resolved where possible.

17.4 If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

17.5 Where an individually agreed written contract conflicts with these Terms, the individually agreed provisions will take precedence, subject to applicable law.

19. Changes to These Terms

19.1 PMJ may update these Terms & Conditions periodically to reflect changes to our services, business operations or applicable legislation.

19.2 The latest version will be published on our website with an updated revision date.

19.3 Changes will not retrospectively alter the terms of an existing confirmed booking unless agreed with the customer or permitted by law.
